Terms of Service

Last updated: 4 November 2026

Welcome to Hit or Miss, a free online multiplayer music party game. These Terms of Service explain the rules that apply when you use our website and game.

Our Privacy Policy explains how personal data is processed.

1. Provider and Contact

Hit or Miss is operated by Mika Hans, trading under the name “Hit or Miss”, Am Roswith-Denkmal 8A, 45527 Hattingen, Germany. Contact: hitormiss.info@web.de.

2. Description of the Service

Hit or Miss allows players to create or join rooms, choose songs in response to prompts, play selected YouTube videos, vote on submissions, guess who submitted each song and compare scores. Features, rules, timers and availability may change as the game is developed.

The game is currently provided free of charge. No paid subscription or in-game purchase is offered under these Terms. We may display advertisements in the future; any paid features introduced later will be governed by additional information and, where necessary, updated terms.

3. Access and Participation

Players can join using a nickname and an automatically created anonymous technical session. You are responsible for choosing a nickname that does not impersonate another person, infringe others' rights or contain unlawful or abusive content.

If you are under 18, you should use the service only where permitted by applicable law and, where necessary, with permission from a parent or guardian. The game is not intended to be used in violation of any age restrictions applicable to third-party services such as YouTube.

4. Fair Play and Prohibited Conduct

You agree not to:

Game rooms are shared environments. Do not include private or sensitive personal information in nicknames or other game inputs.

5. Game Rules

Game modes, scoring and round procedures are explained in the game interface. Players may be asked to select and submit songs within a time limit, vote on tracks and guess which participant selected them. If a participant fails to submit a song, the current game rules may apply a scoring penalty and restrict their guessing options for that round.

In the local mode, music playback is generally intended for the host device; in the online mode, playback may be available on participating devices. Playback may require individual action and depends on external availability.

Technical problems, disconnections and unavailable YouTube videos can affect gameplay. We may correct evident errors or prevent abuse, subject to applicable law.

6. YouTube and Other Third-Party Services

Music is provided through embedded YouTube players. Hit or Miss does not own, host, sell or license the recordings shown through those players. Availability may vary by country, rights holder, device or YouTube restrictions.

Your use of YouTube is also subject to YouTube's applicable Terms of Service and Privacy Policy. We cannot guarantee that a particular video will be searchable, embeddable or playable.

The game also depends on technical service providers for hosting, authentication and multiplayer functionality. Details are provided in our Privacy Policy.

7. Availability and Changes

We aim to keep Hit or Miss accessible, but uninterrupted or error-free availability cannot be guaranteed. Maintenance, service provider outages, connectivity problems and changes to third-party services may interrupt gameplay.

We may improve, modify, suspend or discontinue features for legitimate technical, security or operational reasons, while respecting any applicable statutory rights.

8. Misuse and Access Restrictions

If there are reasonable indications of serious misuse, we may take proportionate measures to protect the service and other users, including preventing access to a room or restricting access to the service where technically possible and legally permissible.

9. Intellectual Property

The website design, software, branding and original game materials are protected by applicable intellectual property laws. You may use the service for its intended personal game experience. This does not grant rights to copy or commercially exploit our software, branding or content beyond what applicable law permits.

Rights to music videos and other third-party content remain with their respective owners.

10. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health caused by a breach of duty for which we are responsible, and in any other cases where liability cannot lawfully be excluded or limited.

In cases of slight negligence, where liability may lawfully be limited, we are liable for a breach of an essential contractual obligation only to the extent of the foreseeable damage typical for the contract. Essential obligations are those whose performance is necessary for the proper operation of the contractual relationship and on whose fulfilment users may regularly rely.

Nothing in these Terms limits mandatory statutory consumer rights.

11. Data Protection

Information about the processing of technical identifiers, nicknames, game data, analytics and third-party integrations is set out in our Privacy Policy.

12. Changes to These Terms

We may update these Terms to reflect changes to the service or applicable law. The current version will be published on this page with its effective date. Changes affecting existing legal rights will be handled in accordance with applicable law.

13. Applicable Law

These Terms are governed by the laws of the Federal Republic of Germany. If you are a consumer habitually resident in another country, mandatory consumer protection provisions of that country remain unaffected where applicable. Statutory rules on jurisdiction apply.
